TERMS

1.        No Minimum opening bid. Sells to the highest bidder regardless of price.

2.        Property sold “as-is”.

3.        Any and all physical testing of the property shall be subject to the written approval of Seller which may be denied and/or conditioned in Seller’s  sole discretion.

4.        Buyer’s Premium of 10% of Hammer price Due and Payable (in certified funds or check with bank letter of guanrantee) at the conclusion of the Auction and becomes part of the purchase price and is Non-Refundable unless seller is unable to furnish marketable title

5.        Closing within 60 days, time is of the essence.

6.        Neither Seller nor Broker makes any representation or warranty, express or implied, as to the accuracy or completeness of any information concerning the Property, including without limitations, any present and future zoning and environmental matters affecting the Property and the condition of the Property, including, but not limited to structural, mechanical, and soil conditions, the presence and location of asbestos, PCB transformers, other toxic, hazardous or contaminated substances, and underground storage tanks, in or about the Property.

7.    The sale is subject to execution of an agreement of purchase and sale by Buyer in form and substance satisfactory to Seller in its sole discretion. A copy of the proposed agreement of purchase and sale can be obtained from the auctioneer.
